Terms and Conditions

  1. Definitions

In the context of these Terms and Conditions, the words below shall have the following meanings:

ATP” means the governing body, incorporated under the laws of England and Wales, of the international men’s professional tennis circuit known as the “ATP World Tour”;

Court” means the tennis court located within the Venue, where the Matches are played;

Customer” means a Ticket or a Pass holder who accepts these Terms and Conditions;

Event” means the ATP’s sport event known as “NEXT GEN ATP Finals”, showcasing top players of the ATP World Tour who are 21 years or younger;

Event Organiser” means the Federazione Italiana Tennis, an association organized under the laws of Italy and made up of all Italian non-profit tennis, beach tennis, padel and wheelchair-tennis clubs and associations, which has been granted by ATP the right to host and organise the Event;

Match” means each tennis match played during the Event;

“Pass”: means an accreditation issued by the Event Organiser that allows the person whose name appears on such accreditation to be admitted to the Venue at the dates and within the specified areas printed on such accreditation;

Polo Fieristico” means the exhibition centre, consisting of exhibition halls, that is located in Milan and Rho, at Strada Statale del Sempione 28;

Privacy Policy” means the privacy policy that can be found on the Web Site at https://ticketing.nextgenatpfinals.com/en/privacy-policy and that is understood to be hereby referred to in its entirety;

Terms and Conditions” means these terms and conditions. The Event Organiser reserves the right to amend these Terms and Conditions. It is the Customer’s responsibility to periodically check these Terms and Conditions for any amendments;

Ticket” means a ticket, which may also be issued in a digital form, giving to its holder the right to gain the entry to the Venue and attend a Match at the dates and during the sessions printed on such Ticket;

Venue” means those Polo Fieristico’s areas specified in the map annexed to these Terms and Conditions, in which the Event will take place and where each Customer is admitted;

Web Sites” means the Next Gen web sites available to Customers at http://ticketing.nextgenatpfinals.com and http://presale.nextgenatpfinals.com.

  1. Contents, purpose and customers’ acceptance

These Terms and Conditions govern the Ticket sale and the admission to the Venue, as described in the following paragraphs.

By purchasing a Ticket or by entering the Venue, Customers accept these Terms and Conditions and the Privacy Policy, hereby referred to in its entirety. In the event the Customer does not accept these Terms and Conditions and/or the Privacy Policy, he will not have the right to purchase a Ticket and/or to access to the Venue.

  1. Terms for access to the Venue

Once these Terms and Conditions have been accepted, the Event Organiser shall grant to the Customer the right to enter the Venue, provided that the Costumer always complies with all rules contained in this paragraph and in these Terms and Conditions.

The admission to the Venue is permitted only to the Customers. In order to enter the Venue, stay and attend a Match, Customers must retain their Ticket or Pass with them at all times.

At the Venue, Customers shall maintain a correct conduct in compliance with politeness and decency. By way of example, Customers are not allowed to climb onto any wall, enclosure, scaffolding, gate or similar structure located within the Venue; radio can only be listened to through headphones; all the mobile phones, laptop computers and electronic devices must be in silent mode when entering the Court’s stands.

Failure to comply with the rules set off in this paragraph may result in Customers being ejected from the Venue without compensation or refund. In any case, the Event Organiser reserves the right to refuse admission to or eject from the Venue any Customer engaged in wrongful conducts or which may be harmful for themselves or for other Customers.

  1. Customers Obligations

In addition to these Terms and Conditions, Customers, when at the Venue, must:

  • strictly comply with the instructions received by the police bodies, security staff and technical personnel appointed at the Venue;
  • comply with the safety rules and all regulations provided for by Polo Fieristico, available at www.fieramilano.it. Failure to comply with the obligations contained in this paragraph may result in Customers being ejected from the Venue without compensation or refund.

 

  1. Prohibitions

For safety reasons and pursuant to Decree Law No 28 of 24 February 2003 (on “Disposizioni urgenti per contrastare i fenomeni di violenza in occasione di competizioni sportive”) which has been converted with amendments into Law No 88 of 24 April 2003, as amended, is forbidden to take inside the Venue the following items:

  • all forms of weapons, scissors, stones, knives, noisy instruments, systems for the emission of light beams (laser pointers), bullets, long handle umbrellas or any other bulky item;
  • stones, marbles and glass objects - such as bottles, glasses and mugs - or any other breakable object that may cause danger to the Customer himself or to other Customers;
  • highly flammable materials and pyrotechnic substances, including fireworks, flares, rockets, gunpowder and any other item used for the emission of fumes or visible gas;
  • spray cans and any substance that may corrode, stain or cause adverse effects on the health of any other individual in the Venue;
  • alcoholic beverages, drugs, poisons or stimulant drugs;
  • promotional items, except in the case of prior written consent of the Event Organiser;
  • propaganda materials containing slogans that may be an incitement or refer to racism, xenophobia, nazism, sexism or politics;
  • flags or banners poles; nevertheless, small flags with synthetic flexible poles or plastic sticks (maximum length: 100 cm, diameter: 1 cm) are permitted;
  • stools or folding chairs.

Animals, with the exception of assistance dogs for the blind and visual impaired, are not permitted in the Venue.

Suitcases, bags or backpacks sized more than 25 cm x 25 cm x 25 cm are permitted in the Venue only if stored in the area specifically provided by the Event Organiser for this purpose.

Without the prior written consent of the Event Organiser, the following items are not permitted in the Venue:

  • professional cameras or video cameras, i.e. any professional device able to take photographs and footage of the quality needed for their use for commercial or advertising purposes;
  • technological devices allowing the real-time disclosure of any Match scores and statistics as well as the transmission by any means, on a live or delayed basis, of the images or sounds related to the Matches or any other event which will take place in the Venue (including, without limitation, interviews, cultural events, promotional activities, etc.);
  • gadgets or promotional and advertising materials.

 

No Customer may: (a) continually collect, disseminate, transmit, publish or release from the grounds of the Venue any Match scores or related statistical data during Match play (from the commencement of a Match through its conclusion) for any commercial, betting or gambling purpose; and (b) film, photograph, broadcast, stream, publish, transmit and/or otherwise offer to the public (or assist any third party in offering to the public), on a live or on a delayed basis, in whole or in part, and whether on a free basis or subject to payment, any sound recording, photograph, video footage, motion picture, film and/or other audio-visual content captured by any means whatsoever inside the Venue (except as is allowed by the Event Organiser in the accreditation policy). The continual use of laptop computers or other handheld electronic devices within the confines (spectator area) of the Event’s Match courts is prohibited. The exception to this provision is properly credentialed media, tournament vendors and tournament staff when used in the performance of their duties.

 

  1. Terms for the Tickets’ usage

Each Ticket is valid only for the admission to the Venue at the date printed on such Ticket and to the Court's stands for the date, session and seat category printed on it. Failure to use a Ticket will not entitle Customers to any replacement with or conversion to another Ticket valid for a later date.

In order to purchase a Ticket, Customers must provide some personal data, such as name, surname, date of birth, e-mail address, fiscal code and country of actual residence. The personal data will be processed by the Event Organiser pursuant to the Privacy Policy.

Customers are aware that the information provided or to be provided to the Event Organiser must be true, accurate, current and complete.

Tickets must be purchased, at the price printed on it, via an authorised ticket agent. Purchase of a Ticket other than via an authorised ticket agent may result in Customers being not admitted to or ejected from the Venue.

Each Ticket entitles its holder to be admitted to the Venue only once. Therefore, without the prior written consent of the Event Organiser, by using the same Ticket there is no re-admission once a Customer has left the Venue.

Customers must produce their Ticket or Pass upon each request made by the Venue stewards. Failure to produce the Ticket or the Pass when required, or the producing of a Ticket or Pass damaged or deteriorated (in any manner that makes it partially illegible) may result in Customers being ejected from the Venue.

Pursuant to all provisions on safety in sports venues (Decree Law No 28/2003, which has been converted, with amendments, in Law No 88/2003, as amended) and pursuant to all provisions on the issue, distribution, sale and assignment of the tickets for admission to sports venues (Law No 88/2003, as modified by Law No 41/2007), the unauthorized sale of Tickets is prohibited. Anyone who, without the explicit consent of the Event Organiser, sells Tickets (in the areas where the Event takes place or in parking and transit areas or in areas involved in transportation of people taking part to or attending the Event) shall be punished with a pecuniary administrative fine from Euro 2,500.00 (two thousand five hundred/00) up to Euro 10,000.00 (ten thousand/00); in the event that the offender sells Tickets at a price higher than the price charged by an authorized agent, such fine may be increased up to the half of the maximum amount.

The offender may be subject to prohibitions and to all provisions set for in Art. 6, paragraphs 1, 1-bis and 2, of Law No 401/1989, as amended (prohibition to access to sports venues for up to 5 years).

  1. Refund

The Event Organiser may refund the Customers for the cost of a Ticket (net of advance sale fee) only in the event that none of the Matches scheduled at the date and session printed on such Ticket is held. In any case, Customers shall have no right to Ticket refund (or exchange) in the event the Matches specified in the purchased Ticket are held at a time different from the time initially scheduled, due to technical-operational reasons. In the event of injury or withdrawal for other reasons, ATP reserves the right to provide alternative participants to those advertised for the Event, and the appearance and participation of such alternates shall not give rise to the right or claim for any refund or exchange.

Customers shall have no right to claim any refund or exchange for any stolen, lost or destroyed Ticket, or for any Ticket damaged in a way that makes it even partially illegible, not even by providing a police report of the theft or loss. Uncollected purchased Tickets shall not be refunded.

Notwithstanding the above with reference to the refund of the costs of the Ticket, under no circumstances (except in the event of fraud or serious misconduct) the Event Organiser shall be liable for any direct or indirect expenses and damages of any nature that Customers may suffer as a result of the purchase of a Ticket and/or any change to the advertised Matches times, as well as of the cancellation of such Matches or the replacement of seats or rows. Except in the event of fraud or serious misconduct, under no circumstances the Event Organiser shall be liable for direct or indirect damages of any nature that Customers may suffer while staying at the Venue. Customers shall be solely liable for any consequences arising from the acts attributable to himself, occurred in the Venue, which may cause damages to the Event Organiser or any third parties, and hereby expressly agrees to indemnify and hold the Event Organiser harmless from any related liability or claim made by third parties.

  1. Filming at the Venue

Closed-circuit television and film cameras may be present at and around the Venue, in order to ensure safety and protection of cultural heritages; the filming of the Event may be used to broadcast the Event in any and all media, including social media outlets operated by the Event Organiser.

Therefore, by accepting these Terms and Conditions, Customers consent to all such filming and agree to their use by the Event Organiser.

The Event Organiser may use all such filming in any manner and in any and all media, on a live or delayed basis, in Italy and worldwide, and may reproduce, adapt, display, distribute, exploit or license the exploitation of all such filming at any time throughout the world and in unlimited time of transmission, by using them via telematic channels and/or via Internet and World Wide Web, also for promotional/commercial purposes and for all purposes related (even if incidentally) to the Event Organiser’s activities. Such use is permitted even if the Customers’ image is included in any such film.

The Event Organiser shall be the exclusive owner of any and all property and exploitation rights, in any manner or form, to the aforementioned film, even if they include the Customers’ image, and may adapt or modify, reproduce or record such film in any form through any channel and by means of any devices now known or hereafter developed, as well as may assign or license them in whole or in part.

The Event Organiser shall not be liable in the event such films are used or reproduced by third parties for different purposes, excluding if such usage is directly attributable to the Event Organiser.

  1. Intellectual property rights

Next Gen ATP Finals is a trademark belonging to ATP which retains all rights in law. All intellectual property rights relating to the Event Organiser and to the Event are subject to copyright and other protection under the laws of Italy and the relevant international conventions.

Customers agree not to reproduce, modify, adapt, produce materials derived from, execute, show, display, distribute, transmit, disseminate, sell, authorize or otherwise exploit the Next Gen ATP Finals trademark, or part of it, nor any of the intellectual property rights belonging to the Event Organiser or the Event. 

Customers acknowledge and agree that the purchase of a Ticket will not give rise to a profit or other right by using Next Gen ATP Finals trademark nor any of the intellectual property right belonging to the Event Organiser or the Event. Customers shall be solely responsible for their conduct.

Attending the Event may result in interaction with third parties’ services. Customers expressly acknowledge and agree that the Event Organiser shall not be liable with reference to products and services offered by third parties.

  1. Discharge of liability

To the fullest extent permitted by law, the Event Organiser or its directors, employees, agents, affiliates and/or licensees shall have no liability whatsoever, express or implied, with respect to the Event.

Even if the Event Organiser plans to conduct the Event according to the scheduled program, there may be events which could determine the rescheduling of the program or cancellation of the Event. The Event Organiser shall have no liability for such rescheduling, suspension or discontinuity in staging the Event.

The Event Organiser does not warrant or assume any liability in relation to any product or service advertised or offered by third parties in connection with the Event; the Event Organiser shall not monitor any operation between Customers and those suppliers of third parties’ products or services.

  1. Limitation of liability

These Terms and Conditions shall apply to all Customers. The Event Organiser shall not be liable in relation to any product or service advertised or offered by third parties in connection with the Event. By purchasing a Ticket, Customers acknowledge and agree that the Event Organiser shall not be liable for any damage, claim nor shall have any other kind of liability arising out of or in connection with the Customers’ use of third parties’ services.

The Event Organiser or its directors, employees, agents, affiliates and/or licensees shall not be liable to Customers for any direct, indirect, economic, exemplary, incidental, special, punitive or consequential damage or loss arising directly or indirectly out of (i) errors or inaccuracies in the content of the Web Sites; (ii) for any damage, loss, personal injury, claim or for any other kind of liability arising out of the admission to the Venue and the attending the Event; (iii) any unauthorized access to or use of the Event Organiser’s server and/or the personal or economic data stored on it; (iv) any interruption or cancellation occurred during the Event; (v) any action undertaken as a result of an investigation conducted on the Customers or other participants to the Event by the Event Organiser or an authority; (vi) any action undertaken as a result of an infringement of copyright or any other intellectual property right; (vii) any damage or loss arising out of the Customers’ attending the Event, irrespective of whether its basis is a warranty, a contract, a tort or any other legal basis and irrespective of whether the Event Organiser has been advised of the possibility of such damages; and/or (viii) the disclosure of information pursuant to these Terms and Conditions or the Privacy Policy. This limitation of liability shall apply to the maximum extent permitted by law.

Customers agree that, in the event they suffer any damage, loss or injury arising out of an Event Organiser’s action or omission, such damage, if any, cannot be considered irreparable or sufficient to entitle that Customer to obtain an order which would jeopardize the staging of the Event. Furthermore, Customers shall have no right to intervene and modify the staging of the Event.

Customers expressly agree that the Event Organiser or its directors, employees, agents, affiliates and/or licensees shall not be liable for any defamatory, offensive or illegal behaviour undertaken by any third party and agree that the risk of injury or damage arising out of such behaviour shall exclusively remain with Customers.

  1. Indemnification

Customers hereby agree to defend, indemnify and hold the Event Organiser or its directors, employees, agents, affiliates and/or licensees harmless against any and all claims, damages, obligations, losses, liabilities, costs or debs and expenses (including, but no limited to, professional fees) arising out of or in connection with:

  1. The entry to the Venue;
  2. The breach of any provisions of these Terms and Conditions;
  3. The infringement of third party’s rights;
  4. The breach of applicable laws, rules, regulations, codes, statutes, ordinances or orders issued by a governing body, including, without limitation, any governmental, administrative or legislative authority;
  5. A misrepresentation undertaken by Customers.

Customers shall support the Event Organiser, as it requires, in defending from claims.

The Event Organiser reserves the exclusive right to assume the defense of any matter otherwise subject to indemnification by Customers and, without prior written consent of the Event Organiser, such Customer shall not settle any such matter. This obligation to so defend and indemnify shall survive the expiration of these Terms and Conditions and the Customers’ attending to the Event.

  1. Ability to accept these Terms and Conditions

Customers warrant that they are over 16 (sixteen) years old and fully able to accept all terms, conditions, obligations, statements, declarations and warranties contained in these Terms and Conditions, as well as that they will fully comply to all provisions contained in these Terms and Conditions.

  1. Appointment

These Terms and Conditions, as well as any other right granted herein, shall in no way be licensed or attributed by Customers to third parties; the Event Organiser shall license them with no restriction.

Customers acknowledge and agree that their relationship with the Event Organiser is of non-confidential and non-fiduciary nature nor of any other particular nature and that their decision to purchase a Ticket does not put the Event Organiser in a position different to the one held by the general public.

  1. Miscellaneous

There Terms and Conditions are governed by the laws of Italy. Any dispute between Customers and the Event Organiser arising out of or in connection with the purchasing of a Ticket or the Event shall be referred to the ordinary courts of Milan (Italy).

These Terms and Conditions, as well as the Privacy Policy and any other legal document issued by the Event Organiser, constitute the entire agreement between Customers and the Event Organiser and supersede all prior agreements between the parties.

Any provisions of these Terms and Conditions found to be void or unenforceable shall not affect the validity or enforceability of any other provisions hereof.

The failure to enforce these Terms and Conditions shall in no way be construed to be a waiver of such term or action or of any other term or action contained in any provision. The failure of the Event Organiser to enforce the provisions of these Terms and Conditions shall in no way be construed to be a waiver of such provisions.

The Event Organiser reserves the right to modify or terminate the staging of the Event at any time and for any reason without notice, without any liability to Customers. The Event Organiser also reserves the right, in its sole discretion, to modify these Terms and Conditions from time to time. Except when modification is due to legal or administrative reasons, the Event Organiser shall provide a notice in reasonable advance before the Terms and Conditions became effective. Customers agree that the Event Organiser can notify any changes of these Terms and Conditions by posting them on the Web Sites. If Customers continue to use the offered services, this can be considered as an acceptance of such a change. Therefore, it is the responsibility of the Customers to periodically check these Terms and Conditions to verify any modifications. If Customers are not willing to accept such modifications, they shall not register on the Web Sites nor purchase the Ticket. The modified Terms and Conditions shall be considered effective as of the moment they are published or at the date specified and shall apply thereafter.
